Examination & Objection

The trademark application is examined by the registry. If objections are raised, clarifications or explanations may be required regarding the mark and its registrability.

Acceptance

If objections are resolved or none are raised, the trademark may proceed further in the registration process, subject to applicable legal provisions.

Journal Publication

Accepted trademarks are published in the Trademark Journal, allowing third parties an opportunity to raise opposition within the prescribed period.

Registration Status

If no opposition is filed or objections are successfully addressed, the trademark may proceed towards registration in accordance with applicable laws and procedures.

Some common questions
were often asked

What is a trademark, and why should I register it?

A trademark is a unique symbol, word, logo, or phrase that identifies your brand or business and distinguishes it from others. Registering your trademark gives you exclusive rights, legal protection against unauthorized use, and helps build brand identity.

Can I use the ™ symbol before my trademark is registered?

Yes, you can use the ™ symbol even if your trademark is not yet registered. It indicates that you are claiming rights to the mark. However, the ® symbol can only be used after the trademark is officially registered.

Can I register a trademark for a business name that's already in use?

No, you cannot register a trademark that is identical or deceptively similar to an existing registered trademark in the same category. However, if it's for a different category or industry, it may be permissible.

Do I need a trademark if I already have a registered domain name?

Yes, a domain name registration does not provide trademark protection. Registering a trademark gives you exclusive rights to use the name for your goods or services, preventing others from infringing on your brand.

Can a trademark protect my business internationally?

No, trademark registration is territorial. If you want protection in multiple countries, you must apply separately in each country or use international systems like the Madrid Protocol for streamlined applications.

Can I transfer ownership of a registered trademark?

Yes, trademarks can be assigned or transferred to another party. This process, known as a trademark assignment, requires filing the appropriate forms with the trademark office and paying the necessary fees.
